Bryan Kohberger Needs His Old Lawyer To Say One Thing

If Bryan Kohberger ever gets a new trial in the Idaho student murders, it will be because one attorney said one thing under oath.

For three years, Anne Taylor could not say a single word about what happened between her and him. Attorney-client privilege sealed it. A change of venue, a gag order, and a mountain of filings never touched it.

Kohberger just unsealed it himself, by hand, from a prison cell.

By arguing that his lawyers were ineffective, he opened the door to everything said in those rooms. And in the affidavit attached to his post-conviction petition, he volunteered something else: both of his parents and both of his sisters sat in on most of those discussions before he agreed to the deal. He offered it as corroboration that he was pressured.

What he actually produced was a list of people who can be placed under oath and asked what was really said.

Tony walks through what an evidentiary hearing in this case would look like if a judge lets it proceed. Taylor sworn. Her co-counsel sworn. His family sworn. And Kohberger himself sworn and cross-examined by the State of Idaho about a confession he gave in open court — something he has never faced once, and something the plea deal was written to spare him.

The timing of that plea is its own story. Prosecutors filed an amended witness list naming a hundred and eighty people who could help convict him. Newly unsealed records show who was on it. He took the deal days later.

There is exactly one way this petition succeeds, and it does not depend on the hair, the affidavit, or anything Kohberger writes. It depends entirely on what one attorney is willing to say under oath — and she has already told the court where she stands.
