Trial Of Caleb Flynn Day 2: Hammond Admitted They Never Recovered WHAT?!

Cross-examination of Ohio BCI Special Agent David Hammond shifted the Caleb Flynn trial away from what was photographed at the scene and toward what investigators never recovered. Hammond testified that the firearm used on Ashley Flynn was never found, giving the defense one of its clearest factual points from this stretch of testimony. 

Hammond also told jurors that he did not personally interview Caleb Flynn. Defense questioning pressed further into the garage evidence, where Hammond had previously criticized the appearance of the damaged door handle. On cross, he acknowledged that he neither weighed the refrigerator positioned against the door nor attempted to move it. 

Defense counsel then presented a different entry theory. Rather than someone breaking through the garage door, the defense suggested that a person could have used a garage-door signal to open it. The theory was raised by the defense during questioning and remains part of its effort to support the claim that an intruder entered the home. 

Caleb Flynn, 40, has pleaded not guilty to 11 charges, including aggravated murder, in the death of his wife and murder victim, Ashley Flynn, 37. Prosecutors allege the burglary scene was staged after Ashley was killed. The defense argues investigators settled on Caleb too quickly and failed to fully account for an outside intruder. 

Redirect gave prosecutors a chance to answer one forensic issue. Hammond testified that gunshot residue is fragile evidence and is not used that often. That testimony addressed the limits Hammond placed on that type of testing without supplying the missing firearm or resolving the defense's alternate-entry argument. 

The jury now has Hammond's prosecution testimony about why he believed the scene was staged, along with the concessions defense counsel drew out on cross. Those two versions of the investigation are now sitting side by side for jurors to weigh.
