Caleb Flynn was convicted of aggravated murder for shooting his wife Ashley in her sleep and staging the scene as a home invasion. His mistress, 24-year-old Alleigha Botner, has not been charged. In testimony, Botner read aloud from more than 107,000 messages between them. She texted Flynn that she wanted Ashley dead. When Flynn allegedly wrote about hiring someone to take Ashley out, Botner replied “so tempting,” according to her testimony. Botner also admitted she coached Flynn on deleting data from his devices, destroyed messages after the killing, and lied to the FBI. Ohio eliminated alienation of affection as a civil claim. The question is whether the texts and the cover-up support a wrongful death or civil conspiracy claim. Bob Motta and Robin Dreeke break down the evidence on both sides.
